Is there a 'perfect' time to file for divorce?

Some people in Minnesota may notice that certain months of the year have more divorce filings than others. For example, one study reports that August and March see the most divorce filings, while others report that January has so many divorce filings that "Divorce Monday" is a common occurrence experienced by many family law offices.

Many of these popular months for divorce are based in part on emotion. People want to wait until after the winter and summer holidays to divorce, not wanting to disturb what should be a happy time for family. However, basing your time to file for divorce purely on emotions may not be the best idea.

Of course, one needs to be emotionally ready to get a divorce, but anyone seeking a divorce should be financially ready to do so as well. First of all, a person should gather together all their important financial and legal documents. Information regarding bank accounts, tax returns, loans, retirement plans, deeds to real property and other financial and legal documents could all be important in a divorce, and a lot of time can be saved if this information is gathered prior to filing for divorce, especially when it comes to asset division.

Second, it can be helpful for a person to open up bank accounts and credit accounts in their name only, before filing for divorce. While there are ways to make it affordable, getting a divorce and establishing a new household as a single person costs money. These accounts should be opened at financial institutions that the person's spouse does not use.

Third, a person should assemble his or her "divorce team." It is entirely possible to interview more than one attorney and then choose the one that is the best fit. An attorney should be trusted and respected, as well as being well-versed in divorce laws. It may also help to seek the advice of a financial advisor and therapist to help you get through the divorce process.

When it comes down to it, there is no "perfect" month to file for divorce. What is important is that you are mentally and financially ready to do so. Taking the steps to ensure your stability ahead of time can help make the divorce process run more smoothly.
