How Do You Know If Spousal Maintenance Applies?

If you are considering filing for divorce and need legal advice as to whether spousal maintenance or alimony may be ordered, Terzich and Ort is here to assist you. Unlike child support, there is no automatic grant of spousal support and there are no guidelines to determine how much should be paid. Our Spousal Maintenance Practice

We represent either party in controversies involving an award of spousal maintenance (also known as alimony). We work with clients at any stage of an alimony dispute, from the determination of temporary spousal support during the pendency of your divorce action through final determinations and post-judgment requests for modification or enforcement of spousal maintenance orders.

What Factors Are Used To Consider Alimony?

Initially, we will help you determine whether alimony is necessary or appropriate, reviewing with you the factors we know the court will consider in its ruling, such as:

  • Length of your marriage
  • Age and health of both parties
  • Prospective earning capacity of both parties
  • Likelihood that both parties will be able to maintain their prior standard of living

If spousal maintenance is a possibility, we can provide advice as to the likelihood of a permanent versus a temporary award. We will also explore whether rehabilitative alimony is the best solution, where spousal maintenance is granted for a period sufficient to allow a party to complete schooling or get training necessary to be gainfully employed.

Spousal maintenance, sometimes recognized as “alimony,” is an award of income from the future earnings of one spouse payable to the other. Spousal maintenance awards may be permanent or temporary. Temporary awards require the payee to rehabilitate and become self-supporting at the end of the temporary award. Rehabilitation is not required in a permanent award.
